9th Circ. Judge says LinkedIn misinterprets judges overthrow

By Dorothy Atkins (Oct. 18, 2021, 10:24 p.m. EDT) – A Ninth Circuit judge on Monday cast doubt on LinkedIn’s arguments that the US Supreme Court’s recent overturning of an earlier panel decision de circuits suggests that LinkedIn may deny a data analytics startup access to public profiles, claiming the judges’ opinion is “irrelevant” to the panel’s earlier decision, which does not appear conflict with recent precedent.

The judge’s comments came during a virtual hearing on an injunction offer that would bar LinkedIn from restricting access to job search startup hiQ Labs Inc ..
