Chennai: In major relief to AIADMK, Madras High Court rejected a lawsuit filed against the Election Commission of India (ECI) for accepting amendments to the party constitution making O Panneerselvam and Edappadi Palaniswami the party coordinator and coordinator. coordinator respectively.
Dismissing the plea filed by lawyer B Ramkumar Adityan of Thoothukudi, the first bench including Chief Justice Sanjib Banerjee and Judge PD Audikesavalu said the EC’s acceptance of the party rule amendments did not appear to be out of order.
The judges also considered that such acceptance was made on the basis of a communication received from representatives of authorized political parties.
The Court also observed that the ECI was not supposed to interfere in the internal problems of each party and check whether the rules and regulations of that party were scrupulously followed.
The judges said that if the petitioner still had grievances, he could go to the civil court to seek an appropriate remedy against the AIADMK.
The petitioner had claimed to have joined AIADMK in December and renewed his membership in 2014. After his membership expired in 2019, it could not be renewed because the party took no action for its renewal.
After Jayalalithaa’s death, AIADMK’s general council appointed his close associate VK Sasikala as interim secretary general, he submitted.
He stated that the EC could not approve his appointment as well as the resolutions adopted at the party’s general council meeting held on December 29, 2016.
After the Supreme Court convicted Sasikala in a disproportionate asset case and sent her to prison, her nephew TTV Dhinakaran was appointed deputy secretary general. But due to factional feuds within the party, the ECI froze the double leaf symbol of AIADMK in March 2017, the petitioner added.
He said that during the AIADMK General Council meeting held on September 12, 2017, 12 resolutions were adopted, including that of replacing the post of general secretary with that of party coordinator and coordinator.
Subsequently, Panneerselvam and Palaniswami took over as party coordinator and joint coordinator respectively, and declared that this major change in the AIADMK constitution should be reversed.
